1. Acceptance of Terms

These terms describe the use of draftmybook, an AI writing service operated by an individual entrepreneur. The service is intended for adults aged 18 and over. Your order and the information presented before payment define what you buy. Nothing in these terms removes mandatory consumer rights.

2. Description of Service

draftmybook is an AI-powered writing service. You provide ideas, characters and plot elements, and we generate complete works from them: novels and non-fiction, comics and graphic novels, children's picture books, screenplays, TV pilots and episodes. Book covers are included with the finished work. Output is delivered as EPUB, PDF or TXT depending on the format, and books are prepared for you to review, edit and submit to platforms such as Amazon Kindle Direct Publishing (KDP). You handle publication and must follow the receiving platform's requirements. Acceptance and sales are not guaranteed.

3. Intellectual Property Rights

Your Content: You retain rights you hold in your inputs. As between you and draftmybook, you may use, edit and sell the output, and draftmybook takes no royalties or share of your sales. No attribution to draftmybook is required. This permission does not guarantee copyright protection, exclusivity or freedom from third-party rights. AI output can resemble other output; copyright protection depends on applicable law and human contributions. Review your work and obtain any permissions needed before publishing.

Our Service: The draftmybook platform, including its design, features, and underlying technology, remains our intellectual property.

4. User Responsibilities

You agree to:

• Provide accurate account information
• Not use the service to generate illegal, harmful, or infringing content
• Not attempt to reverse engineer or copy our technology
• Not use the service to harass, defame, or harm others
• Comply with all applicable laws when publishing generated content

5. Prohibited Content

You may not use our service to generate content that:

• Promotes violence, hatred, or discrimination
• Contains illegal material or promotes illegal activities
• Infringes on copyrights, trademarks, or other intellectual property
• Contains sexually explicit content involving minors
• Constitutes spam, fraud, or deceptive practices

6. Payment Terms

Payments are processed through Stripe. Prices are shown in USD. Subscription plans renew automatically unless cancelled; annual plans are charged upfront. The order summary identifies the amount and billing interval before payment. Changing an advertised price does not itself change an existing subscription's agreed terms.

What a subscription buys is credits, which are spent when you generate something. Two rules govern them, and both are enforced automatically:

• Credits do not roll over. Your balance is replaced on your monthly billing anniversary, and anything unused at that point expires. Annual plans receive twelve monthly allowances during the paid year. If a month has no matching day, the refresh falls on its last day.
• Credits are forfeited when a subscription ends. Cancelling keeps your access until the end of the period you have paid for. Remaining credits do not carry forward. Statutory withdrawal, refund and conformity rights remain applicable.

Credits have no cash value and cannot be transferred between accounts. See our Refund Policy for details on refunds.

Consumers may have a 14-day withdrawal right and statutory rights relating to defective digital content or services. Starting generation alone does not waive these rights. You can withdraw from a purchase online. The refund and withdrawal policy explains deadlines, exceptions and how to submit a notice.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. If an interruption or defect affects what you bought, your statutory remedies remain available.

8. Disclaimer of Warranties

AI-generated content may contain factual errors, repetition or similarities to other material. We do not promise uniqueness, marketplace acceptance or income. You should review facts, rights and suitability before publication. These limitations do not exclude legal guarantees or the obligation to provide the service as described.

9. Limitation of Liability

To the maximum extent permitted by law, draftmybook shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim. This limitation does not apply where prohibited by mandatory law and does not restrict your legal consumer remedies.

10. Termination

Access may be suspended where necessary to address unlawful use, material breaches of these terms or a security risk. Your rights in respect of paid services remain subject to applicable law. You can manage subscription renewal from your account, and contact support to request account closure. Closing an account and cancelling future billing are separate requests.

11. Changes to Terms

We may update these terms for future orders and notify you of significant changes. An update does not retrospectively remove rights from an existing purchase. Changes to an ongoing service remain subject to applicable notice and consumer rules.

12. Governing Law

French law applies, without depriving consumers of mandatory protections that apply in their country of habitual residence. Disputes may be brought before the courts that have jurisdiction under applicable law. Nothing here requires a consumer to give up a court or remedy available under mandatory consumer rules.
